The Ethics of Hate Essay The First Amendment principles of free speech have been under attack since the Amendment came into being. The very nature of speech gives rise to argument because it is a personal undertaking; something that belongs to the individual alone. An individual’s beliefs can not be judged, and speech is an expression of those beliefs. Thus, the question: Is it wrong to allow speech that strikes at the heart of an individual? The hatefulness of speech is a subjective matter that can not properly be defined by government and, therefore is an unreasonable restriction of first amendment rights. The goal of the free speech doctrine is centered upon an ethical debate; that is, how much freedom should be given to citizens of a free society while still providing a protected environment in which to live? (Weinstein 11) The Constitution is very clear on the right to freedom of expression when it states that, â€Å"Congress shall make no law abridging the freedom of speech. † However, the interpretation of the First Amendment by the Supreme Court in Schenck v. United States put the first real restriction on free speech when it imposed the qualification that speech could not give rise to a â€Å"clear and present danger† (Weinstein 17). This first restriction led to the rule being broadened to such an extent that it caused suppression of unpopular political speech (Weinstein 19). The Supreme Court later narrowed the rule to outlaw any speech that tended to incite dangerous action. Once again, the rule was abused and often used to stifle minority speech, one of the very groups the Amendment was meant to protect. (Weinstein) So, the dilemma has continued and still rages, especially with regard to â€Å"hate† speech. There is no rational argument that hate is good. Yet, when hate is embodied in open speech, is that speech itself the culprit or the speaker? What is hateful to one person may not be to another, so is it the proper thing to do to censor all speech that is interpreted as hateful by anyone? Most authorities agree that, â€Å"[h]ate speech includes the use of hurtful, biased expression; threats of violence based on sex, race, ethnicity, religion and sexual orientation; and offensive songs, jokes or events, such as fraternity slave auctions (Miller, and Andsager). Some of these forms of speech are indeed hurtful, even reprehensible, but at the same time they represent a fundamental truth of our society; individual ideas should not be censored because those in authority find them morally wrong or personally offensive (Weinstein 16). Those that would support a ban on hate speech raise the position that it is for the benefit of society as a whole that restrictions should be imposed. They rightfully point out that hate breeds hate and we, as a community, should take the responsibility of seeing that the spread of hateful beliefs is stopped. Cortese states that, â€Å"[s]ocietys mainstream culture, or a subculture, transmits the building blocks of hate speech to children as much at home as throughout the community† (3). While the goal of living in a society free of discrimination, hate and fear is an admirable one, it can not be achieved by curtailing our civil liberties. Neither can it be attained by smothering the best hope for change – the university and college campuses where traditionally the dramatic transformations of societal norms have always taken place. Restrictive speech codes on college campuses have periodically surfaced, usually during times of civil unrest. However, in the late 1980’s there was an alarming number of universities implementing restrictive codes in some form or another. The proliferation of restrictive campus speech codes was wholly unprecedented: never had there been such strong support for punishing offensive speech (Walker 127). There was such a rise of discriminatory behavior on college campuses that the courts began applying cases outlawing a â€Å"hostile environment† for minorities to the Universities. Even the courts realized, however, that campus speech codes could not be all inclusive and acknowledged that [a]cademic freedom sometimes includes the discussion of controversial subjects such as gay marriage, evolution, or affirmative action (Cortese 2). The very core of our democratic ideals is traced to the free exchange of opinions in our educational environments. If free expression of one’s thoughts can not be safely uttered inside the walls of universities, then we have given up the right chart our own futures; and the ideal society that we all strive will no longer exist. Individual rights are the very essence of our democracy. To unreasonably restrict those rights defeats the its every purpose An ethical responsibility to treat everyone in our society with respect and tolerance most certainly exists, but that respect can not just be for the politically correct groups. It also has to be applied to all those who the majority of us despise in order for it to mean anything. Though `hate speech` is harsh and hurtful, it is protected by the First Amendment and therefore, should not be regulated by the government or college campuses.

Middle Managers

Managers are the most important human resource in any organisation because they are charged with the responsibility of ensuring that the organisational goals are achieved within the specific time through spending less financial resources. Both organisations and people need each other to further their different goals or objectives. Therefore if mutuality is missing, it makes no sense in trying to assemble a group and develop a cooperation because there is no common base on which to build. Therefore, for attainment of organisational effectiveness, human resource and especially the middle level managers is the most important asset that must be paid attention by the management.Management practices are employed by middle managers in order to enhance the effectiveness of any organization including learning institutions, and these management activities are planning, organizing, leading, and controlling. The middle managers through the planning function is responsible in coming with a schedu le of business activities that will result to attainment of the set goals. The middle managers outline what to be done and the expected output from the employees.The organizing function of any organization has to deal with the issue of allocating the tasks to the employees respectively according to their competence. Resistance by the workers may be experienced if the allocating process used is viewed to be inappropriate and oppressing which always leads to poor organization performance. Middle managers in many learning institutions in an effort to be effective and efficient in the workplace have the responsibility of balancing the ever competing demands of their roles brought about by conflicts from both the top management and the subordinates or the low level management. In order to attain the above objective this middle level managers have embarked on various critical roles in order to avoid any misunderstandings in the workplace and thus achieve the desired ou tput. Such roles include the following: (Fiddler, and Atton, 1999)Middle managers in learning institutions act as change agents within these organisations. Globalization has taken the centre stage almost in all sectors of the economy including learning institutions. There is increased interaction of people from different cultures, societies, and various backgrounds in undertaking various business activities with the aim of achieving their goals for example opening learning branches in other countries. Because of invention of advanced technology the world has increasingly become a village and as a result global business is the modern form of business in this 21st centuryBecause of globalization in relation to learning institutions there have been great disregard to national borders, governments have lower hand in controlling the flow of their economies and large companies including learning institutions are now not restricted to only one particular country as it was before. Middle le vel managers in learning institution have to cope with changes brought about by this aspect of globalization and they should brief the top management on decision making process. They also have the task of ensuring that the teachers in this institution are equipped with skills, expertise, and knowledge that can tap new knowledge from other people from different countries without hindering the learning process.Middle managers have the duty of being a strategist in order to cope with the increasing demands from both the top management and the low level management. This implies that they have the tasks of ensuring that the strategies formulated by the organisation are implemented and executed in a good way that will lead to achievement of goals. They should therefore have the ability to interpret direction from the top managers in to functional departmental strategies and policies that will avoid any conflicts in the organisation and those plans must be viable and supportive for the mis sion of the organisation. A strategy may be defined as the calculated means by which the enterprise deploys its resources to accomplish its purpose and basic objectives under the most advantageous circumstances. Therefore the middle level mangers have the task of ensuring that the organisation   for example learning institution must be overall low cost effective system which will ensure good returns for example high performance through use of competent teachers and using of advanced technologies. So the work of middle managers is to ensure sourcing of competent teachers and application of approved high quality technologies e.g. the use of white boards.Middle level managers must also act at ethicists in any organisation in order to balance the competing demands brought about by the interactions with both top and low level managers. Thi s role implies that the middle managers especially those from learning institutions should develop a system that will help them sustain pressure from both top managers and subordinates in the process of promoting moral conduct within the organisation   that will foster good results. For example teachers will be motivated to lecture/teach and students too will be motivated to work hard and achieve their results.   The other role middle managers have to embark on is the responsibility of being a team player in the organisation or in the workplace. For these middle managers to maximize the concept of teamwork in the organisation then they should emphasize on formation of groups within the workplace.A group can be defined as social unit which people interacts face to face when working. Sometimes some kind of work require teamwork participation in order to achieve goals, so managers should encourage group decisions too because they bound to succeed unlike individual decisions. Research indicates that poor communication is probably the most frequently cited source of interpersonal conflicts. It is only through transmitting meaning from one person to another that ideas and messages can be conveyed.Communication can play the following functions; controlling employee’s behaviour, motivating the workforce, provides a release for emotional expression of feelings and performs the role of facilitating decision making in organisation. Proper channels of communication should be put in place in learning institution and this will help the organisation to attain their set goals for example teachers reporting to their head teachers then the head teachers to senior managers then to the executive arm respectively if there have been a problem to be solved. (Edmondson, Bohmer and Pisano, 2001)Leadership is another concept that middle level managers should emphasize on. Without proper leadership, organisation’s effectiveness and efficiency cannot be achieved and bad leadership in an organisation may cause poor results and thus lack of attainment of objectives.   It should also be noted that not all managers are leaders and not all leaders are managers. Leaders can emerge from within a group as well as by formal appointments to lead a group. If a department has targeted certain kinds of offenses or if supervisors adhere to strict enforcement guidelines and closely monitor dispatches and other communications, the discretionary release of suspects will be quite rare. 4. Community Interest- Public attitudes toward certain crimes will increase the likelihood of arrest for suspected offenders. Contemporary attitudes toward crimes involving children- including sex abuse, sale of drugs to minors, domestic violence involving children and child pornography- have all lead to increased and strict enforcement of laws. Once the community has voiced its concern over the problem, the police respond with a series of highly effective arrests. The departments that require a police officer to live in the area that he/she patrols make them more aware of the effects of crime on the community and they respond better than a person who doesnt live in their district. 5. Pressure from Victims- When victims refuse to file a complaint are usually associated with certain crimes such as spousal abuse. When victims refuse to cooperate with the police, there is often little that can be done. On the other hand, some victims are local in insisting in the victimization and can easily be dealt with. Victim-assistance groups have sought to keep pressure on police departments and individual instigators to ensure the arrest and prosecution of suspects. 6. Disagreement with the law- Some laws lack an unpopular consensus. Some of the laws that deal with victimless offenses are gambling, homosexuality, lesbianism, prostitution and drug use. Some laws are not even in certain jurisdictions. Unpopular laws are not likely to bring much attention from law enforcement officers. If an arrest were to occur, it could be because an officer digs deeper into his/her investigation and reveals something more serious about the crime. 2) Name and describe the four historical eras of policing as discussed in the book. (4 pts) The four historical eras (epochs), are distinguishable by the relative dominance of a particular approach to police operations. They are the political era, reform era, the community policing era, and the homeland security era. 1. Political Era The first period, the political era, was characterized by close ties between police and public officials. It began in 1840 and ended around 1930s. Throughout the period, American police agencies tended to serve the interest of powerful politicians first, and providing public-order services almost as an afterthought. 2. Reform Era- The second period, the reform ear, began in the 1930s and lasted until the 1970s. It was characterized by pride in professional crime fighting. Police departments focused more on solving traditional crimes, such as murder, rape, burglary, and focusing on capturing offenders. 3. The Community Policing Era The third period, and the one that characterizes much of policing in America today, is the community policing era. This era started in the 1970s and is still present today. This was an approach to policing that stresses the service role of police officers and envisions a partnership between police agencies and their communities. This era grew with national concerns with terrorism prevention born of the terrorist attacks of September 11, 2001. (5 pts) Some dangers of police work include: violence in the line of duty, risk of disease and infected evidence, and stress and fatigue among police officers. 1. Violence in the line of duty In 2007, 188 American law enforcement officers were killed in the line of duty. These officers were kind-hearted, and laid back, and well liked in the community. 2. Risk of disease and infected evidence -Routine criminal and accident investigations hold the potential for infection through transmission of evidence. 3. Stress and fatigue among police officers Traumatic events, like hurricanes, terrorist attacks, and violent confrontations are instantly stressful. These can affect police officers long term. Diet and exercise can decrease stress and fatigue, along with getting more sleep and taking care of their body. 4) What ethnic and gender differences characterize policing today? What is the social significance of this diversity? (5 pts) Today many departments have dramatically increased their complement of officers from unrepresented groups. There are not as many African American officers or other ethnic officers compared to white (Caucasian) officers in the field. Although ethnic minorities are now employed in policing in significant numbers, women are still significantly underrepresented. Texas clarified the use of informants and established a two-pronged test. The US court ruled that informant information could establish probable cause if both of the following criteria are met. 1. The source of the informants information is made clear, and 2. The police officer has a reasonable belief that the informant is reliable. The two-pronged test was intended to prevent the issuance of warrants on the basis of false or fabricated info. (Schmallenger, Frank, 2010). IL (1964) -In the case of Escobedo vs. Illinois, the right to have legal counsel present during police interrogation was recognized. (The area of policing the ruling affected: Interrogation) D. Miranda v AZ (1966) -This case established the well-known Miranda Warnings. In this case involving Enesto Miranda, who was arrested in Phoenix, Arizona, and was accused of having kidnapped and raped a woman. (The area of policing the ruling affected: Interrogation) E. Harris v US (1968) Police officers have the opportunity to begin investigations or to confiscate evidence, without a warrant based on what they find in plain-view and open to public inspection. The plan-view doctrine was succinctly stated in the US Supreme court case of Harris v. US. (The area of policing the ruling affected: Search and Seizure) F. Weeks v US (1914) Freemont Weeks was suspected of using US mail to sell lottery tickets, which is a federal crime. Weeks was arrested and feral agents went into his home to conduct a search. They had no search warrant. They confiscated many items for evidence as well as the suspects personal possessions, including clothes, books, papers, and even candy. US v Leon (1984) In the 1984 case of US v Leon, the court recognized what has come to be called the good-faith exception to the exclusionary rule. Borchardt, decided by the 5th circuit court of Appeals, held that Ira Eugene Borchardt could be prosecuted for heroin uncovered during medical treatment, even though the defendant had objected to the treatment. Because of this case guidelines for conducting emergency warrantless searches of individuals came into effect, and in order to use evidence against an offender in a warrantless search certain criteria has to be met. Kyllo v Us (2001) This case set the standard on how technology can be used to the police based on the results of a warrantless search conducted by officers using a thermal-imaging device to detect if his housing was giving off more heat than the other houses, investigators applied for a search warrant for Kyllos home.
